Perfect10 vs. Google |
| A little primer for the whole Perfect10 vs. Google matter : "Perfect 10 sued Google in November of 2004. It says that Google is displaying hundreds of thousands of adult images, "from the most tame to the most exceedingly explicit, to draw massive traffic to its website, which it is converting into hundreds of millions of dollars of advertising revenue.
Perfect 10 claims that under the guise of being a search engine, Google is displaying, free of charge, thousands of copies of the best images from Perfect 10, Playboy, nude scenes from major movies, nude images of supermodels, as well as extremely explicit images of all kinds.
The publisher contends that it has sent 35 notices of infringement to Google covering over 6,500 infringing URLs, but that Google continues to display over 3,000 Perfect 10 copyrighted images without authorization."

Now what happened a couple of days ago was that Google woke up from it's slumber and banned a huge list of sites from it's index and these sites are no longer present in any search results. The full list can be seen here.
Now, no one is arguing that Perfect10 was wrong to do this. They have a right to protect their copyrighted content. Only problem is, it seems Perfect10 had also purchased content from some companies who are also sponsors running affiliate programs such as Hegre, Modelflats and Mac & Bumble. It seems that the same content that was sold to Perfect10 was also given to affiliates for promotion. End result? Some of those affiliates have ended up as copyright infringers and have been banned by Google.
You can call this as you see it. Some would call it collateral damage and some would call it foul play, depending on which side of the fence you're on. No doubt it's a good example to set for copyright infringements, but if you're one of those in the banned list, and you haven't infringed on anyone's content, then you might not be feeling so kindly disposed, as you can see here.
Update : 21st Feb 2006 : "Judge: Google infringes on some adult entertainment copyrights" from an article in the San Jose Mercury News. Jusge Matz ordered both sides in the case to craft a narrow preliminary injunction that would respect Perfect 10's copyrights but not curtail Google's broader right to catalog and display images found on the Internet.
Smart Judge, but bad example. If this works for Perfect10, there's bound to be a clamour from a lot of others, adult and mainstream, to clip Google's vast footprints. Keeping watch on this issue. Updates as and when availbale.
Update : 28th Feb 2006 : NewNudeCash.com, promoters for Herge-Art, seem to have persuaded the Google folks to unban their affiliates - Quote : "e are pleased to announce that as of today all of OUR affiliates are now unblocked by Google.com. As one of our affiliates, and an important member of the http://www.NewNudeCash.com family, we would like you to know that we do not take an issue like this lightly. To ensure this situation does not happen again, we are also taking legal action against Perfect 10."
Whatever - So now it's Google and these sponsors Vs. Perfect10. Maybe I should update the title of this page.
